Development of design documentation for the construction of a stand-alone shelter at a nuclear power plant in Europe

Our client had acquired the right to perform work on the development of project documentation for the construction of a stand-alone shelter at a nuclear power plant in one of the European countries. The peculiarity of the Agreement was that the architectural and construction, space-planning and design solutions had to be implemented in accordance with the requirements of the regulatory framework and technical regulations in force in the above-mentioned European country. A person who was a resident of the given country and possessing applicable special knowledge had been engaged to perform work on a subcontract basis. During the negotiations with a subcontractor (non-resident), it became possible to draft the framework of the contract and to agree the terms allowing the client to minimize the risks of his liability to the customer for possible violations that could  be in turn caused by violations by the subcontractor, namely, the contract established the responsibility of the subcontractor, identical to that of the clients’ responsibility  to the customer.  An agreement was reached on the application of special norms of the Civil Code of the Russian Federation on contracting in terms of regulating relations between the Parties arising in the course of work, as well as on acceptance and transfer of its results.
